Welcome to The Gift Heaven. These Terms & Conditions govern your access to and use of the website https://thegiftheaven.com, as well as any purchase made through the website.

By accessing, browsing, using this website, or placing an order, you acknowledge that you have read, understood, and unconditionally agreed to be legally bound by these Terms & Conditions.

If you do not agree with any part of these Terms, you must refrain from using this website or purchasing any products from The Gift Heaven.

1. Eligibility & User Responsibility

  • To place an order on this website, you must be at least 18 years of age.

  • Users under 18 years may place orders only with the explicit consent of a parent or legal guardian.

  • You are solely responsible for ensuring that all information provided (including recipient details, address, and contact number) is accurate, complete, and up to date.

  • The Gift Heaven shall not be responsible for delivery failure due to incorrect or incomplete information provided by the customer.

2. Pricing, Products & Information Accuracy

  • All prices displayed on the website are listed in Bangladeshi Taka (BDT) unless stated otherwise.

  • Prices are subject to change without prior notice.

  • While we make every effort to ensure accuracy of product images, descriptions, and pricing, typographical, technical, or human errors may occur.

  • In such cases, The Gift Heaven reserves the absolute right to correct errors, revise prices, cancel orders, or refuse service at any time.

3. Order Confirmation & Cancellation

  • An order shall be considered confirmed only after full advance payment has been successfully received.

  • Once an order is confirmed, it cannot be cancelled, modified, or refunded, unless otherwise approved in writing by The Gift Heaven.

4. Returns, Refunds & Exchanges

Product Inspection

  • Customers must inspect the product in the presence of the delivery personnel within 5–10 minutes of delivery.

  • The product must not be taken out of the delivery personnel’s sight during inspection.

  • Any claims or disputes raised after the delivery personnel has left will not be entertained.

Defective Products Only

  • Returns or exchanges are applicable only for verifiably defective products.

  • Customers must notify The Gift Heaven within 1 (one) business day of delivery.

  • The product must be returned within 3 (three) business days.

  • Returned items must be unused, undamaged, in original packaging, and with all tags intact.

Refunds

  • All returned items are subject to inspection and quality verification.

  • If approved, refunds will be processed within 7 (seven) business days to the original payment method.

Exchanges

  • Exchanges are subject to product availability and The Gift Heaven’s final decision.

Shipping Costs

  • All return or exchange shipping costs shall be borne by the customer.

  • Shipping charges are non-refundable under all circumstances.

5. Delivery Policy & Limitation of Responsibility

  • Order processing and delivery will commence only after payment confirmation.

Estimated Delivery Timelines (Under Normal Conditions)

  • Dhaka City: Within 24 hours

  • Outside Dhaka City: Within 72 hours

  • For customized, surprise, birthday, or anniversary deliveries, orders will be delivered on the customer’s specified date and time via our in-house delivery team.

Force Majeure

The Gift Heaven shall not be held liable for delays or failures caused by circumstances beyond our control, including but not limited to:

  • Natural disasters

  • Political unrest

  • Government restrictions

  • Strikes

  • Traffic congestion

  • Unforeseen events

Delivery Charges

  • Dhaka City: BDT 250

  • Sub-urban areas: BDT 800

  • Outside Dhaka District: BDT 1,500

Delivery charges may vary depending on product type, size, weight, quantity, or special handling requirements.

6. Payment Terms

  • The Gift Heaven does not generally offer Cash on Delivery (COD) services.

  • All orders must be fully prepaid to be confirmed.

  • Payments are processed via secure third-party payment gateways, including SSLCommerz.

  • The Gift Heaven shall not be responsible for payment failures, delays, or gateway-related technical issues.

7. Product Color, Images & Visual Representation

  • Due to variations in camera settings, lighting, screen resolution, and devices, actual product colors may vary by up to 10%.

  • Such variations shall not be considered defects and are not eligible for refunds or exchanges.

  • Unless customization is explicitly requested, products will be delivered as shown in the images, with no option for color changes.

8. Limitation of Liability

  • The Gift Heaven shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of this website or purchased products.

  • Under no circumstances shall The Gift Heaven’s total liability exceed the total value of the relevant order.

9. Amendments to Terms

  • The Gift Heaven reserves the right to modify, update, or replace these Terms & Conditions at any time without prior notice.

  • The latest version published on the website shall be deemed final and binding.

10. Governing Law & Jurisdiction

These Terms & Conditions shall be governed by and construed in accordance with the laws of the People’s Republic of Bangladesh.
Any disputes shall fall under the exclusive jurisdiction of the courts of Bangladesh.
